These Terms & Conditions (“Terms”) govern your use of MemoBanao(“the Service”), provided by Netrik Technology Pvt Ltd (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
MemoBanao is software for transport agents and commission agents to create memos, maintain party and truck owner ledgers, calculate commission, and manage their transport business through a web application and Android app.
2. Free trial
New accounts receive a 30 day free trial with access to the Service. No payment is required to begin the trial. At the end of the trial, you may choose a subscription plan to continue using the Service. Details of available plans are shown within the application.
3. Accounts and eligibility
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for keeping your login credentials and MPIN confidential.
- You are responsible for all activity that occurs under your account and the accounts of users you add.
- You agree to provide accurate information and to keep it up to date.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent or harmful purpose.
- Attempt to gain unauthorised access to the Service or other users’ data.
- Interfere with, disrupt or overload the Service or its infrastructure.
- Copy, resell, reverse engineer or create derivative works from the Service.
5. Your data, access and export
You retain ownership of the business data you enter into the Service. You grant us a limited licence to host and process that data solely to provide the Service to you, as described in our Privacy Policy. You are responsible for the accuracy and legality of the data you enter.
All data created within MemoBanao (including memos, ledgers, party and truck owner records, reports and related information) is stored in MemoBanao’s own format and is designed to be opened, read and used only through the MemoBanao application. It cannot be opened, operated or reconstructed in any other software or environment.
You may request an export or backup of your data at any time. Any such export is provided in MemoBanao’s format and remains accessible and restorable only through MemoBanao. It is not supplied in a form intended to be opened in other applications.
6. Subscriptions and payment
After the free trial, continued use of the Service requires an active subscription. The plans, features and prices available to you are displayed within the application. Unless stated otherwise, fees are not refundable and exclusive of applicable taxes.
7. Availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may perform maintenance, update features, or modify the Service from time to time.
8. Disclaimers
The Service is provided on an “as is” and “as available” basis. MemoBanao is a tool to help you record and manage your business; it is not a substitute for professional accounting, tax or legal advice. You are responsible for verifying figures and meeting your own compliance obligations.
9. Limitation of liability
To the maximum extent permitted by law, Netrik Technology Pvt Ltd shall not be liable for any indirect, incidental, special or consequential damages, or loss of profits, revenue, data or business, arising out of or related to your use of the Service.
10. Termination and account deletion
You may stop using the Service and close your account at any time. Account deletion is available on request: contact us and we will delete your account and its associated data, except where we are required to retain certain records to comply with a legal obligation.
We may suspend or terminate your access if you breach these Terms. Before deletion takes effect, you may request an export of your data as described in Section 5 and our Privacy Policy.
11. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hyderabad, India.
